Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck by hazards:    (a) On or about March 31, 2016 for employees exposed to fall and struck-by hazards while working on and around an elevated work platform with a width of approximately 16 feet that was attached to the forks of a Gehl 883 telehandler with a wheelbase of apprixmately 7.5 feet, near the intersection of 43rd Avenue South & South 32nd Street in Grand Forks, North Dakota.    Abatement Note: Among other methods, one feasible and acceptable means of abatement to correct the hazard would be to comply with the manufacturers recommendations and/or to follow the mandatory requirements set forth in ANSI B56.6 Safety Standards for Rough Terrain Forklift Trucks, Section 8.25.1(b) which states:  floor dimensions which shall not exceed two times the load center distance listed on the rough terrain forklift truck name plate, measured parallel to the longitudinal center plane of the truck, nor have a width greater than the overall width of the truck measured across the load bearing tires plus 10 inches (250mm) on either side.  Minimum space for each person on the platform shall not be less than 18 inches (450mm) in either direction.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a) On or about March 31, 2016 for employees working from an elevated work platform approximately 16 feet wide that was attached to a Gehl 883 telehandler near the intersection of 43rd Avenue South & South 32nd Street in Grand Forks, North Dakota.
