OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) On 03/11/2016, entrance to jobsite at 42-12 28th Street, Long Island City, NY Employees walking and working on site were exposed to being struck-by Yodock barriers with a chain linked fence installed on top while walking by the barrier. The barriers were not interlocked, were not filled with water or sand and were resting on wood pallets making them unstable. On 03/11/2016, one of the barriers fell over, striking the employee of a subcontractor. b) On or about 03/24/2016, entrance to jobsite at 42-12 28th Street, Long Island City, NY Employees walking and working on site were exposed to being struck-by Yodock barriers with a chain linked fence installed on top. The barriers were not interlocked, were not filled with water or sand and were resting on wood pallets making them unstable. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
