The lower guard did not cover the saw to the depth of the teeth, except for the minimum arc required to allow proper retraction and contact with the work. When the tool is withdrawn from the work, the lower guard did not automatically and instantly return to the covering position: a) At the new multi-family residential construction site, where employees were exposed to struck-by hazards while using a Makita circular saw with the lower guard in the opened position.
