29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:      a) Production Floor- On March 31, 2016, the employer did not ensure that setup employees were adequately trained to understand the purpose and function of the energy control program and that the knowledge and skill required for the safe application, usage, and removal of the energy controls were acquired by the employees who perform tasks that requires them to have any part of their body in a hazardous area, including conducting setups and clearing jams.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) was not done in sequence to achieve energy control by performing the following steps as required by 29 CFR 1910.147(d)(1)-(6):    a) Production Floor: On March 31, 2016, employees were exposed to machine hazards associated with moving parts and ingoing nip points during setup and clearing of jams on machines, including the Neff #181 Horizontal Press.     The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per 1910.147 (d)(2) requirements]. As as result, the remaining applicable energy control elements, involving machine isolation[(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation[(d)(6)], were not implemented to protect employees from machine servicing hazards.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during the operating cycle(s):    a) Production Floor- On March 31, 2016, the employer did not ensure that the guard on the Neff #181 Horizontal Press was properly designed in a manner that would prevent employees from having any part of their body in the danger zone during the operating cycle.  b) Production Floor- On or about March 24, 2016, the employer did not ensure that Horizontal Press #180 was properly guarded, near the lubricating spray station, in a manner that would prevent employees from having any part of their body in the danger zone during the operating cycle.
