29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. Warehouse- In the following instances, forklifts were found to be in need of repair and were not taken out of service until such repairs had been made: a.) Forklift #62 was missing a brake pedal rubber pad. b.) Forklift #25 had cuts in the positive and negative battery connections.

29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. Warehouse- In the following instances, the load engaging means were not fully lowered and/or the parking brakes were not set after the operator dismounted the forklifts: a.) Forklift # 62- The load engaging means were not fully lowered when the operator dismounted the forklift. b.) Forklift # 25b- The load engaging means were not fully lowered nor was the parking brake set when the operator dismounted the forklift.
