29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. At the jobsite, an employee operated a Hitachi nail gun to perform framing activities without eye and face protection exposing him to the hazard of being struck-by flying objects.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest system. At the jobsite, employees performing framing activities were not provided fall protection and exposed to an unprotected fall hazard at a height of over 6 feet to the ground below. Jose Jaimes was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 891532, Citation Number 1, Item number 1, and was affirmed as a final order on May 22, 2013, with a final abatement date of February 22, 2013, with respect to a workplace located at 305 Desert Sky Drive, McGregor, TX 76657.
