OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a roll-over hazard: The employer allowed employees to operate an Exmark Zero Turn Ride-On lawn mower equipped with manufacturers roll over protection bar to be operated on inclines and near waterways without ensuring that the roll over protective structure (ROPS) was engaged in the upright and locked position.
