29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103) On or about April 4, 2016 at a worksite located at 177 Mill Street in Menasha, WI, the employer did not establish or implement a written respiratory protection program when employees were required to wear 3M 8511 N95 dust masks to protect from silica dust generated during dry cutting of concrete with a Stihl TS 800 cut-off machine. All provisions of 29 CFR 1910.134(c) through (m) must be covered in a written respiratory protection program.
