29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person.  On or about April 1, 2016, the employer did not ensure scaffolding used at the site was constructed in accordance with the design by a qualified person.  Therefore, the scaffold design lacked the required capacity ratings, safety factors, and stability assurance.  This exposed employee(s) to fall hazards.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  On or about March 29, 2016, the employer did not ensure employees engaged in new residential framing activities, working at leading edges, unprotected edges, and at a height greater than six (6) feet above ground level, were provided fall protection training, exposing the employees to fall hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b).   On or about April 1, 2016, employees engaged in decking activities of an apartment complex were not using any method of fall protection, exposing the employees to a fall from a height greater than six (6) feet.   MPS Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard  29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 975239 (Perales Construction Company), citation number 1, item number 2, and was affirmed as a final order on September 15, 2014, with respect to a workplace located at 19501 N. Pennsylvania Ave., Edmond, Oklahoma 73012.   MPS Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 952376, citation number 1, item number 1, and was affirmed as a final order on April 1, 2014, with respect to a workplace located at 6205 157th St., Oklahoma City, Oklahoma 73113.  MPS Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314931635 (Miguel Perales), citation number 1, item number 2, and was affirmed as a final order on June 7, 2011, with respect to a workplace located at 3440 N.W. 172nd Street, Edmond, OK 73012.
