29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about April 5, 2016, for the employees preparing a pipe for the installation of a manhole in a trench approximately 9 feet deep without adequate protective systems located at the vicinity of 51st street South and 31st Avenue South, West Fargo, North Dakota. Note: This company was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 901211, citation number 1, item number 1b and was affirmed as a final order on October 17, 2013, with respect to a workplace located at the intersection of Broadway and Sixth Avenue North in Fargo, North Dakota.
