29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems where not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) Rays Backhoe Services, LLC, at 2740 Darley Ave., Boulder, CO 80305: On and before April 5, 2016, the creating and controlling employer excavated a trench approximately 9 feet deep with vertical walls for use in a sewer relining project. The employer did not ensure that daily inspections of the excavations, adjacent areas, and protective systems were made by a competent person for evidence of possible cave-ins, the failure of protective systems, or other hazardous conditions. Condition exposed employees to cave-in and other hazards.
