29 CFR 1926.651(j)(2):  Employees where not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    (a) Aqualine Services at 2740 Darley Ave., Boulder, CO 80305: On and before April 5, 2016, the exposing employer allowed employees to work in a trench approx. 9 feet deep to reline a sewer pipe, with the spoil pile located immediately adjacent to the vertical trench wall.  The employer did not ensure that these employees were protected from excavated or other materials that could pose a hazard by falling or rolling into the excavation.  Condition exposed employees to struck-by hazards from the spoil pile located at the edge of the trench.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems where not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.     (a)  Aqualine Services at 2740 Darley Ave., Boulder, CO 80305: On and before April 5, 2016, the exposing employer failed to ensure that daily inspections of excavations and protective systems where made by a competent person prior to the start of work and as needed throughout the shift when employee exposure could be reasonably anticipated.  The employer allowed employees to work in an unprotected trench that was approximately 9 feet deep with vertical walls.  Condition exposed employees working in the trench to potential cave in and other hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section;  (a)  Aqualine Services, at 2740 Darley Ave., Boulder, CO 80305: On and before April 5, 2016, the exposing employer allowed employees to work in a trench approximately 9 feet deep, with vertical walls and no shoring, to reline a sewer pipe.  The employer did not ensure that employees were from cave-ins by an adequate protective system.  Condition exposed employees to potential cave in and entrapment hazards.
