29 CFR 1910.147(c)(2)(ii): The employer's energy control program under 29 CFR 1910.147(c)(1) did not utilize lockout where the energy isolating device was capable of being locked out.  On or about 4/2/16 in the Evisceration Department on the inside line; the employer allowed employees to clean and sanitize the Probes of the BAADER JOHNSON Cropping machine (BADDER BA 1424, Customer #100035, Serial #382) with exposed moving parts, and without locking out the mechanical controls of the machine; thus exposing an employee to a thumb amputation

29 CFR 1910.147(c)(4)(ii)(D): The energy control procedures did not clearly and specifically outline the requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control.  On or about 4/2/16 in the Evisceration Department on the inside line; the employer's Lockout/Tagout Periodic Inspection failed to verify the effectiveness of the lockout procedure in that the procedures allowed employees, during cleaning and sanitizing, to be exposed to moving parts, including the Probes, of the BAADER JOHNSON Cropping machine (BADDER BA 1424, Customer #100035, Serial #382); thus exposing an employee to an amputation hazard.
