29 CFR 1926.103: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter. 29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: (a) On April 5, 2016, at the I-90/Touhy Ave. project, Omega Demolition Corp. did not ensure that the employee using the 3M Powerflow face-mounted powered air purifying respirators (PAPR), used it in compliance with the conditions of its NIOSH certification. The 3M Powerflow face-mounted PAPR was being used with MSA opti-filter cartridges. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.103: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter. 29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used. (a) On April 5, 2016, at the I-90/Touhy Ave. project, employee(s) using 3M Powerflow face-mounted powered air purifying respirators were not fit tested when a different respirator make was used. Employee(s) used 3M Powerflow face-mounted powered air purifying respirators when their fit test approved use of MSA powered air purifying respirators. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
