29 CFR 1926.502(b)(2)(iv): Other structural members (such as additional midrails and architectural panels) were not installed such that there were no openings in the guardrail system that were more than 19 inches (.5m) wide: a) At the site, on April 6, 2016, a secondary structural member was not installed to decrease the space between the midrail and the ground, leaving an opening of approximately 36 inches, exposing employees to fall hazards.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) On April 6, 2016, the designated competent person performing the daily inspections was not competent in that he was not capable of identifying the hazards posed by a guardrail system not constructed in accordance with 29 CFR Subpart M.
