A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. (a) Job Site - On or about April 6, 2016 two employees were working inside a 9.8 foot deep trench without ladder or stairway.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that: (a) Job Site - On or about April 6, 2016 two employees were exposed to hazard of cave-in in a 9.8 foot deep trench.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Job Site - On or about April 6, 2016 two employees were exposed to cave-in hazard from the lack of inspection by a competent person. No determination was made as to the soil classification prior to employees working inside trench with no cave-in protection.
