OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a. On or about April 7, 2016, in the interior of the structure (attached to the framing), employees used a wooden job made ladder without filler blocks inserted between the rungs to support the cleats, exposing themselves to a 12-foot fall hazard.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a. On or about April 7, 2016, on the top plate of a structure, three employees performing decking operations were not protected from a 24-foot 5-inch exterior fall hazard by use of a guardrail system, safety net system, personal fall arrest or any alternative fall protection. b. On or about April 7, 2016, on the top plate of a structure, three employees performing decking operations were not protected from a 12-foot interior fall hazard by use of a guardrail system, safety net system, personal fall arrest or any alternative fall protection.
