On or about April 07, 2016, at the above addressed jobsite, an employee was operating a powered industrial vehicle (Lull 1044C-54) during material handling operations. The operator of the powered industrial truck did not complete the required training and evaluation specified in paragraph (l).

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold: a. On or about April 07, 2016, at the above addressed jobsite, an employee landing material from a tubular welded scaffold, approximately thirty (30) feet above the lower surface, was not protected from falls, thereby exposing the employee to fall hazards.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following: a. On or about April 07, 2016, at the above located jobsite, employees performing masonry operations were exposed to the hazards associated with chemicals such as, but not limited to Portland cement. The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) will be met.
