29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) 705-727 Fairmount Ave, Philadelphia, PA - The employer did ensure that the employee operating the JLG material handler was successfully trained and evaluated in operating that machine thus exposing employees to struck-by and or caught-in-between hazards. This condition was observed on or about March 31, 2016.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas:  a) 705-727 Fairmount Ave, Philadelphia, PA - During the course of the construction project the employer did not ensure that scrap lumber with protruding nails was kept clear from work areas thus exposing employees to trip/fall and puncture wound hazards. This condition was observed on or about March 31, 2016.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes, more than six feet above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  a) 705-727 Fairmount Ave, Philadelphia, PA - Employees working on the first floor approximately 8 feet above the next level were not protected from falling through floor holes by the use of covers or some type of fall protection system. This condition exposed the employees to fall hazards on or about March 31, 2016.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings  where the outside bottom edge of the wall opening is 6 feet or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:  a) 704-727 Fairmount Ave, Philadelphia, PA - The employees working at window openings approximately 20 feet above the ground without having guardrails in place thus exposing the employees to fall hazards. This condition was observed on or about March 31, 2016.
