29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied. A. Aaron Miller DBA A & J Construction worksite located at 5875 Hagman Rd., Toledo, Ohio: On or about April 8, 2016, the employer did not ensure the manufactured platform was secured to the forks of the JLG 6036 rough terrain lift. An employee was working from the platform approximately 15.00 feet above the lowest level. The platform had securing pins but were not used.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. A. Aaron Miller DBA A & J Construction worksite located at 5875 Hagman Rd., Toledo, Ohio: On or about April 8, 2016, the employer did not ensure an employee was wearing proper eye protection while operating a pneumatic nail gun on the East side of the multi-story commercial structure. The employee was exposed to potential flying object hazards while operating the pneumatic fastener. A & J Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.95(a) which was contained in OSHA inspection number 1074985, citation number 1, item number 1b and was affirmed as a final order on August 21, 2015 with respect to a workplace located at Delta, Ohio.
