29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) On or about 3/30/16 at a construction project located at the corner of Spencerport Road and Manitou Road, Gates, New York; employees were placing metal roofing on a steep slope roof with a pitch of 6 in 12 and an eave height of approximately 11 feet. There were no fall protection systems in place.    NO ABATEMENT CERTIFICATION REQUIRED

The platform height was approximately 11 feet high and there were no fall protection measures in place.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:    a) On or about 3/30/16 at a construction project located at the corner of Spencerport Road and Manitou Road, Gates, New York; employees were using portable nibblers and shears to cut metal roofing for a pre-engineered building. The extension cord feeding the tools was missing the ground prong.    NO ABATEMENT CERTIFICATION REQUIRED    Finger Lakes Construction Co. Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 638198, citation number 1, item number 1 and was affirmed as a final order on 10/23/12, with respect to a workplace located at 1120 Bullis Road, Elma, New York.    Finger Lakes Construction Co. Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 826681, citation number 1, item number 1 and was affirmed as a final order on 2/15/13, with respect to a workplace located at 2240 Southwestern Boulevard, West Seneca, New York.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.    a) On or about 3/30/16 at a construction project located at the corner of Spencerport Road and Manitou Road, Gates, New York; an employee was using a scissor lift to access the roof of the building. The employee climbed up and over the guard rail to access the roof. The employee was exposed to falling approximately 11 feet from climbing over the guardrail.    NO ABATEMENT CERTIFICATION REQUIRED    Finger Lakes Construction Co.
