29 CFR 1926.300(b)(4)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  95 Coles St., Jersey City, NJ.  Employees were observed utilizing a chop saw with a by-passed guard that didn't allow the guard device to be fully functional as its intended purpose for protecting employees from being injured at the point of operation, there-by exposing employees to amputation hazards.   Violation occurred on or about 03/29/2016

All 120-volt, single-phase 15- and 20-ampere receptacle outlets on construction sites, which are not a part of the permanent wiring of the building or structure and which are in use by employees, shall have approved ground-fault circuit interrupters for personnel protection.    a.) 95 Coles St., Jersey City, NJ.   Employees were observed using receptacle outlets that were not approved or deemed acceptable as a Ground-fault circuit interrupters under according to 29 CFR 1926.449(a); there-by exposing employees to electrical hazards.       Violation occurred on or about 3/29/2016.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.  a.) 95 Coles St., Jersey City, NJ.  Employees were observed working on the 3rd level of a supported scaffold without adequate fall protection, there-by exposing employees to potential fall hazards approximately 25 ft. to the ground level or to the next lower level. 29 CFR 1926.501(b)(2)(i): Each employee who is constructing a leading edge 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems.    a.) 95 Coles St., Jersey City, NJ.  It was learned that Employees were engaged in leading edge work that wasn't provided with a adequate fall arrest system to protect employees from being exposed to fall hazards approximately 10ft above the ground level below. 29 CFR 1926.451(e)(9)(iv): Cross braces on tubular welded frame scaffolds shall not be used as a means of access or egress.  a.) 95 Coles St., Jersey City, NJ.    Employees were observed utilizing cross braces on scaffold as their sole means of access to upper levels and egress to lower levels, there-by exposing employees to fall hazards from approximately 2-3 stories high above the ground surface.     Violation occurred on or about 3/29/2016.  Tacuri Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(9)(iv), which was contained in OSHA inspection number 1088342, citation number, 1 item number 1 and was affirmed as a final order on 11/18/2015, with respect to a workplace located at 766 Main St., Paterson NJ
