29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system. (a)Blue Haven Barn and Gardens @ 46594 W. 268th St., Sioux Falls, SD 57106: On and prior to April 5, 2016, the controlling contractor did not ensure each subcontractor employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system. Subcontractor employees engaged in construction activities accessing the second level were exposed to fall hazards while walking/working. This condition exposed subcontractor employees to a fall hazard of 12 feet.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with one handrail and one stairrail system along each unprotected side or edge: (a)Blue Haven Barn and Gardens @ 46594 W. 268th St., Sioux Falls, SD 57106: On and prior to April 5, 2016, the controlling employer did not ensure that the main stairway within the building, was equipped with an adequate stairrail system, in that the midrail was not appropriately installed. Subcontractor employees were using the main stairway access to work on the second floor. This condition exposed subcontractor employees to a fall hazard of approximately 12 feet.
