29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:    a)  Jobsite - On or about April 4, 2016, the employer allowed an employee to operate and work from an a articulating aerial lift (Model: Sunbelt 460SJ S/N: 525841) within close proximity of 115 Kilo-volt energized overhead power lines, exposing employees to electric shock and burn hazards.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into pysical or electrical contact with the electric power circuit.     a)  Jobsite-on or about April 4, 2016, the employer allowed employees to work from an articulating aerial lift  (within 10-feet of an energized 3-phase, 115 Kilo-volt overhead power line, which exposed employees to shock and electrical hazards. The employer recognized the hazard associated with the overhead power lines; however, the employer failed to inform the workers of the hazards involved, post and maintain warning signs and take protective measures.
