OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) 7081 Swedetown Road, Theodore AL; On or about April 12, 2016 and at times prior thereto the employer exposed employees to fall hazards in that employees were allowed to work off of a platform elevated by a forklift which did not meet the design requirements of ANSI B56.1-2005, specifically the guardrail requirements for platforms used for elevating personnel.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition. a) Shop Area; On or about April 12, 2016 and at times prior thereto the employer exposed employees to slip/trip and fire hazards in that employees were required to walk and work in areas that had large quantities of used scrap fiberglass, paper and other trash piled up.
