29 CFR 1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks):  On or about April 12, 2016, in the facility, employee(s) required to perform steel fabrication voluntarily used half-mask, air-purifying respirators when welding.  The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use did not present a health hazard to the user.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about April 12, 2016, in the facility, employees required to perform steel fabrication operated a Yale battery-powered sit-down forklift truck.  The employer did not ensure that each powered industrial truck operator was competent to operate the forklift truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l).

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected:  On or about April 12, 2016, in the facility, employees required to perform steel fabrication operated a Yale battery-powered forklift truck.   The forklift truck had not been examined daily before being placed in service.

The rated load of the crane shall be plainly marked on each side of the crane, and if the crane has more than one hoisting unit, each hoist shall have its rated load marked on it or its load block and this marking shall be clearly legible from the ground or floor:  On or about April 12, 2016, in the facility, employees required to perform steel fabrication operated pendant-controlled overhead bridge cranes that did not have the rated load of the crane plainly marked on each side of the crane.
