OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:   a) On or about February 23, 2016, the employer did not ensure that employees followed the manufacturer's instructions for the safe operation of a digger derrick. The manufacturer's safety guidelines state, "The EZ Hauler 4100 is not designed to carry passengers. Never ride on the machine".  Employees were exposed to a struck-by hazard when the S.D.P. EZ Hauler model 4100 tipped over and fell onto an employee being allowed to ride on the machine during operation resulting in broken bones and a laceration wound to the back of the neck.  b)  On or about February 23, 2016, the employer did not ensure that employees followed the manufacturer's instructions for the safe operation of a digger derrick. The manufacturer's instructions for driving the EZ Hauler 4100 state, "Warning: the EZ Hauler 4100 should only be driven with the tracks fully extended" and "Moving the EZ Hauler 4100 through a small opening, once through the gate the tracks must be moved to full extension to improve stability". Employees were exposed to a struck-by hazard when the S.D.P. EZ Hauler model 4100 tipped over and fell onto an employee resulting in broken bones and a laceration wound to the back of the neck. At the time of the accident the machine was being operated with the tracks in the retracted position reducing the machine's stability.
