OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  On or about 4/14/2016 in the store room;   a. employees were exposed to fall hazards above 9 feet (113") where the ladders did not extend 3 feet above the landing; employees entering the overhead storage loft above the entrance to the back room to store or remove materials such as but not limited to hardware and products for sale, were required to step onto the top step of the 7 foot portable Werner ladders and negotiate 22 inches to the landing;  b. employees were exposed to fall hazards above 9 feet (103") where the ladders did not extend 3 feet above the landing; employees entering the overhead storage loft above the restroom to store or remove materials such as but not limited to hardware and products for sale, were required to step onto the top step of the 7 foot portable Werner ladders and negotiate 12 inches to the landing.

29 CFR 1910.22(d)(1): On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate:  On or about 4/14/2016 in the storage room: employees placing and removing materials such as but not limited to hardware and retail products into the loft areas are exposed to collapse where the floors are not designed for storage and were marked with "NO STORAGE" in 6 inch stenciling; the heights were:   a. above 9 feet (113") to the concrete floor below at the loft above the entrance to the back room; b. above 9 feet (103") to the concrete floor below at the loft above the rest room.
