29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): 1662 Westfield Street, West Springfield, Massachusetts; Employee was exposed to an unprotected fall of approximately 23.5 feet while working on the roof of a two story colonial style home. The employee was wearing a harness but it was not connected to a lanyard with an anchor point. Fitzgerald Roofing was previously cited for a repeat violation of this occupational safety and health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 995842 citation 2 item 1 and inspection 760042 citation 2 item 1. Inspection 995842 was affirmed as a final order on October 9, 2014. Inspection 760042 citation 2 item 1 was affirmed as a final order on January 8, 2013. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: 1662 Westfield Street (RT. 20), West Springfield, Massachusetts; Ladders used to access the roof bracket scaffolds on the roof did not extend a minimum of 3 feet above the point of access. The height of the eave to the ground was approximately 23.5 feet. Fitzgerald Roofing was previously cited for a repeat violation of this occupational safety and health standard 29 CFR 1926.1053(b)(1) which was contained in OSHA inspection number 995842 citation 1 item 1a. Inspection 995842 was affirmed as a final order on October 9, 2014. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).

29 CFR 1926.1053(b)(12): Ladders used where the employee or the ladder could contact exposed energized electrical equipment did not have nonconductive side rails: 1662 Westfield Street (Route 20), West Springfield, Massachusetts; An aluminum ladder was set up and used to access the roof of the porch within 2 feet of the weatherhead and electrical meter for the residence. The weather head was approximately 17 inches from the edge of the porch where the ladder was erected. Fitzgerald Roofing was previously cited for a repeat violation of this occupational safety and health standard 29 CFR 1926.1053(b)(12) which was contained in OSHA inspection number 995842 citation 1 item 1b. Inspection 995842 was affirmed as a final order on October 9, 2014.
