Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible aluminum dust explosion, deflagration and other fire hazards while performing hot work at or near the aluminum brusher machine and its associated dust extraction system: (a) Aluminum brusher machine area - On or about April 8, 2016, a deflagration event occurred within the new aluminum dust extraction system while workers were performing hot work activities utilizing spark producing tools, including a grinder, with the extraction fan operating. Hot work was performed without the use of a permit and the approval of a qualified person to ensure ignition sources were controlled. (b) Aluminum brusher machine area The new aluminum dust extraction system was not designed and installed to ensure the ducts were as short and straight as possible and to maintain a minimum conveying velocity throughout the system to prevent the accumulation of dust in the system. On or about April 8, 2016 a deflagration event occurred in the ducting system. The ducts were not cleaned and purged of combustible aluminum dust prior to performing hot work on the duct.

29 CFR 1910.1200(g)(1): Chemical manufacturers and importers did not obtain or develop a safety data sheet for each hazardous chemical and for each chemical that posed a hazard not otherwise classified that they produce or import: (a) Lawrence & Fredrick, Inc. - On or about April 18, 2016, the employer did not ensure that Section 2 (Hazard(s) Identification) the Safety Data Sheets (SDS) for Wrought Aluminum Products, 1xxx Series Alloy did not contain the required Single word ("Warning") and Hazard statement ("May form combustible dust concentrations in air"). Per 1910.1200, abatement for this item must include an updated SDS as well as confirmation of transmission of the updated SDS to the downstream users.
