29 CFR 1926.101(a): Ear protective devices were not provided and/or were not used when it was not feasible to reduce noise levels or duration of exposures to those specified in Table D-2, Permissible Noise Exposure, in 29 CFR 1926.52. On or about April 19, 2016 and at times prior thereto, employees were not provided with any type of hearing protection while using a jackhammer for demolition. This condition exposed employees to health hazards.

29 CFR 1926.501(b)(1): Employees on walking/working surfaces with an unprotected side and/or edge which is 6 feet or more above a lower level were not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. On or about April 19, 2016, and at times prior thereto, employees were observed performing demolition work on top of a commercial building without any type of fall protection. This condition exposed employees to falls hazards from 6 feet or greater.
