29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: On or about April 20, 2016, at the above addressed jobsite, the employer did not adequately maintain a program of frequent and regular inspections by a competent person to protect employees against fall hazards posed by a deficient guardrail installation. Employees were exposed to fall hazards of approximately thirty-three (33) feet. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.502(b)(5): Midrails, screens, mesh, intermediate vertical members, solid panels, and equivalent structural members were not capable of withstanding, without failure, a force of at least 150 pounds (666 N) applied in any downward or outward direction at any point along the midrail or other member: On or about April 20, 2016, at the above addressed jobsite, the employer did not ensure the mid rail of guardrails in use were capable of withstanding a force of at least 150 pounds to protect employees from falling while performing residential framing and carpentry operations. Employees were exposed to fall hazards of approximately thirty-three (33) feet. There is no abatement certification or documentation required for this item.
