29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:      a) On or about 4/20/16, on painting jobsite at house, 325 Summer St., Buffalo, NY:  Employees engaged in construction work including painting were not trained to recognize potential hazards on this type of jobsite, including but not limited to falls from roofs, ladders, stairs & scaffolds, electrical hazards, unguarded tools/machines, fire hazards, and the need for personal protective equipment to protect them from various hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards.         ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:      a) On or about 4/20/16, on the east side of house at 325 Summer St., Buffalo, NY:  An employee was exposed to potential fall of approx. 28 ft. while painting the soffit from the elevated basket of a JLG Model 600S aerial lift. The employee was not wearing a body harness or belt, and was not tethered to the basket or lift in any other way.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:      a) On or about 4/20/16, on the lower roof, north side of the house at 325 Summer St., Buffalo, NY:  Employees were exposed to potential fall of up to approx. 28 ft. while painting windows and sweeping the roof deck. The roof was flat and there was no parapet wall.  No fall protection system was utilized.        NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:       a) On or about 4/20/16, at the lower roof, north side of the house at 325 Summer St., Buffalo, NY:  An extension ladder was set up on the east side of the house to access and exit the lower roof. The side rails of the ladder only extended about 16 inches above the roof landing.      NO ABATEMENT CERTIFICATION REQUIRED
