29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. a- 371 Hope Chapel Road, Lakewood NJ: Employees using New York Stucco Roller Grade Weather Barrier with the ingredient Portland Cement were not provided with the proper hand protection nor were they provided with any respiratory protection while mixing and pouring the stucco cement. Condition observed and note on or about 04/21/16. NOTE: IN ADDITION TO ABATEMENT DOCUMENTATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: a- 371 Hope Chapel Road, Lakewood NJ: Employees were exposed to fall hazards, in excess of 24 feet to the ground surface below, when performing stucco application and other related activities from the second story roof with a pitch of approximately 2 on 12. These employees were wearing full body harnesses with lanyards attached back to the harnesses and not the proper tie off point(s) at the time of the worksite inspection. Condition observed on or about 04/21/16.
