29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:   a. In regards to citation 1, item 1, issued on June 7, 2016, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, June 17, 2016.  The violation read as follows:    29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities six feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:  The employer does not protect each employee from the hazard of falling by the use of fall protection devices.  This most recently occurred on April 20, 2016, at Building 14 at the Villas at Foor Farms located 115 Stone Gate Drive Pataskala, Ohio 43062. Employees working from a residential roof at a height greater than six feet were doing so without fall protection.  This employer has been previously cited for this practice that included:  Lucas Rivera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 738961, citation number 1, item number 1, issued on November 29, 2012 and was affirmed as a final order on January 13, 2013, with respect to a workplace located at Santorinni Drive, Building 36 New Albany, Ohio 43015.  Lucas Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314593237, citation number 1, item number 3, issued on May 10, 2011 and was affirmed as a final order on July 15, 2011, with respect to a workplace located at 5402 Wilcox Road Dublin, Ohio 43016.
