29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a.  On or about August 29, 2017, at the site located at 6184 Sedge Lane, Hilliard, Ohio, employees were performing framing work on a two story apartment building while standing on the second story floor level at approximately 10 feet in height with no fall protection, thereby exposing the employees to a fall hazard.  The Lucas Rivera Martinez dba LM Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1141586, citation number 1, item number 1 and was affirmed as a final order on November 15, 2016, with respect to a workplace located at 115 Stone Gate Drive, Pataskala, Ohio 43062.  Lucas Rivera  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 738961, citation number 1, item number 1 and was affirmed as a final order on January 13, 2013, with respect to a workplace located at Santorinni Drive, Building 36, New Albany, Ohio 43015.
