OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.) Consolidated Electric Distributors, Inc. dba All Phase Electric Supply Co. located at 3535 N. Holland Sylvania Rd. Toledo, OH 43615; The employer did not ensure employees were protected from fall hazards while fixing gutters on the backside of the building. On April 15, 2016, an employee was lifted up on a pallet by the Raymond Renewed stand up forklift to fix gutter seams, and fell approximately 8-10 to the asphalt below after the forklift hit the door ramp. Abatement method would be to ensure a manufacturer approved personnel cage is used when lifting personnel to perform this type of work. Additionally, no longer performing this type of work in house, and hiring a 3rd party professional would also be acceptable abatement. -Follow the guidelines of ANSI B56.1-2005: Safety Standard for Low Lift and High Lift Trucks. 4.17.1 Only operator-up high lift trucks have been designed to lift personnel. If a work platform is used on trucks designed and intended for handling materials, the requirements of paras. 4.17.2 and 4.17.3 shall be met for the protection of personnel. 4.17.2 Whenever a truck is used to elevate personnel, the following precautions for the protection of personnel shall be taken: (c)Be certain that required restraining means such as railings, chains cable, body belt(s) with lanyard(s), or deceleration devices, etc. are in place and properly used.
