An employee was fine grading pea stone with a hand rake, following and within extreme close vicinity of an excavator. The excavator backed up and the tracks pinned the employee's leg. The employee was not instructed to stay a safe distance from the swing and operational track of the excavator.   NO ABATEMENT CERTIFICATION REQUIRED

The employee did not hear the backup alarm and the backup alarm was not distinguishable from the surrounding construction noises.   NO ABATEMENT CERTIFICATION REQUIRED
