29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about 4/6/16, at the crash wall area of the site, Lewiston Bridge US Plaza, Lewiston, NY. An employee was fine grading pea stone with a hand rake, following and within extreme close vicinity of an excavator. The excavator backed up and the tracks pinned the employee's leg. The employee was not instructed to stay a safe distance from the swing and operational track of the excavator. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level or did an employee signalled that it is safe to do so: a) On or about 4/6/16, at the crash wall area of the site, Lewiston Bridge US Plaza, Lewiston, NY. An excavator was placing pea stone and backing up, the track of the excavator pinned one employee's leg. The employee was behind the excavator fine grading the pea stone with a rake. The employee did not hear the backup alarm and the backup alarm was not distinguishable from the surrounding construction noises. NO ABATEMENT CERTIFICATION REQUIRED
