29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a) 811 Owls Nest Road, Greenville, DE  19807 (Scaffolding for Stone Masonry Wall) - On or about April 21, 2016, employees were not wearing protective helmets while they walked on the ground below other employees working above from a scaffolding platform.  Employees on the ground were susceptible to the possibility of head injury if an employee working above was to accidentally displace an object such as a masonry stone over a leading edge of the platform above where an employee on the ground was positioned.    Pursuant to 29 CFR 1903.19, the employer must submit abatement certification, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(h)(1):  Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards:  (a) 811 Owls Nest Road, Greenville, DE  19807 (Scaffolding for Stone Masonry Wall) - On or about April 21, 2016, employees on the ground were susceptible to being struck by falling objects as toeboards or another protective system to prevent employees working above from accidentally displacing objects such as hand tools on masonry stone over the edge of the platform above an employee on the ground directly below.   Pursuant to 29 CFR 1903.19, the employer must submit abatement certification, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.451(b)(5)(ii): The end of a platform greater than 10 feet in length extended over its support more than 18 inches and the platform was not designed and installed so that the cantilevered portion of the platform is able to support employees and/or materials without tipping, or has guardrails which block employee access to the cantilevered end:   (a) 811 Owls Nest Road, Greenville, DE  19807 (Scaffolding for Stone Masonry Wall) - On or about April 21, 2016, employees were exposed to a fall hazard as the ends of a plank greater than 10 feet in length extended over the scaffolding supports to lengths greater than 18 inches.  Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
