29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. On April 22, 2016, employees were working on the roof of a residential building without having adequate knowledge in using fall protection equipment. This condition exposed employees to falls greater than 6 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. On April 22, 2016 and times prior to, employees were working on the roof of an apartment complex without using any form of fall protection. Employees were exposed to fall hazards of more than six feet to the ground. Manuel Mena was previously cited for a violation of this occupational safety and health standard, 1926.501(b)(13), which was contained in OSHA inspection number 1012947, citation number 1, item number 1a and was affirmed as a final order on 04/21/2015, with respect to a workplace located at 6305 Franklin Buff, El Paso TX 79912.
