OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while walking and working in the vicinity of moving vehicles and equipment. a) Workplace - 114 Sylvester St., Westbury, NY: An employee that was sorting material in the recycling yard was struck by a Caterpillar 928G that was being backed up in the vicinity of where he was working; on or about 04/16/16. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours. a) Workplace - 114 Sylvester St., Westbury, NY: An employee was struck by a Caterpillar 928G - Wheel Loader. The employee was hospitalized and treated for a fractured leg; on or about 04/16/16. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
