29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   Paint Department: On or about April 21, 2016, the employer did not provide medical evaluations for employees that were required to a wear 3M half mask respirator, which could create physiological burdens and respiratory difficulties.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  Paint Department: On or about April 21, 2016, the employer required employees to wear a 3M half mask respirator, which could create physiological burdens and respiratory difficulties, and the employees were not fit tested prior to use.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  Paint Department: On or about April 21, 2016, the employer allowed employees that were required to wear a 3M half mask respirator during sanding and spray painting operations to have facial hair in the seal area of their respirator, which interfered with the sealing surface of the facepiece.     Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
