29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) a) 1275 Cedar Lane-MOT Charter School, Middletown, DE-On or about 4/21/2016 the employer failed to maintain programs which provided for frequent and regular inspections of the job site, materials, tools and electrical protective equipment and other personal protective equipment. Note: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written documentation.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: a) 1275 Cedar Lane-MOT Charter School, Middletown, DE-On or about 4/21/2016 the employer permitted two employees to work in proximity to energized electric power circuits without protection against electrical shock, resulting in two employees being exposed to an electrical shock, one of them suffering burns. Note: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written documentation.
