29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to chemical burn hazards:    Jobsite, 180 Water Street, Plymouth, MA:    Employer used a tank trailer equipped with a pump and hose that were not designed for pumping corrosive liquids in bulk. On or about April 22, 2016, while an employee was using the tank trailer to fill containers with liquid chlorine (sodium hypochlorite), the connection between the hose and pump failed and liquid chlorine spilled onto the parking lot of the jobsite.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    Establishment and jobsite:    Employer had not developed and implemented a written Hazard Communication Program for employees who were exposed to hazardous pool chemicals such corrosive hydrochloric (muriatic) acid and liquid chlorine (sodium hypochlorite) that included labeling requirements, safety data sheets, and employee training. On or about April 22, 2016, an employee began filling a container of hydrochloric acid with sodium hypochlorite causing a reaction that produced hazardous gases such as chlorine and other chlorinated species.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    180 Water Street, Plymouth:    Employer's PPE assessment did not include all elements required by this section such as:    a) Selecting, and having each affected employee using, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  b) Communicating selection decisions to each affected employee; and,  c) Selecting PPE that properly fits each affected employee.    The PPE assessment did not include PPE that would adequately protect the hands, eyes, face, and body of the employees who were exposed to liquid chlorine (sodium hypochlorite) and hydrochloric acid during handling. On or About April 22, 2016, an employee began filling a container of hydrochloric acid with sodium hypochlorite causing a reaction that produced hazardous gases such as chlorine and other chlorinated species.
