29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds were not fully planked or decked between the front uprights and the guardrail supports: (a)SECO, Inc. @ 404 Campbell Street, Rapid City, SD 57702: On and prior to April 13, 2016, the employer did not ensure two employees were protected from fall hazards on the working platform on the fabricated frame scaffold. The scaffolding system was not fully planked, in that, the scaffold was 5.2 feet wide and only 24 inches were planked. This condition exposed the employee to a fall of approximately 14 feet and 17 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level: (a)SECO, Inc. @ 404 Campbell Street, Rapid City, SD 57702: On and prior to April 13, 2016, the exposing employer did not ensure that employees were protected from a fall from elevation, in that, guardrails or other suitable fall protection were not properly installed on the working platform of the scaffolding. The scaffold on the north side of the commercial building under renovation lacked proper guardrails on both the 3rd and 4th levels of two different scaffolding systems. One employee was standing on planking of the 3rd level scaffold platform removing existing eave and the other employee was standing on planking on the 4th level assisting. This condition exposed employees to falls of approximately 14 and 17 feet.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)SECO, Inc. @ 404 Campbell Street, Rapid City, SD 57702: On and prior to April 13, 2016, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Two employees were working off of two separate sections of scaffolding engaged in removing existing eave on a commercial building while exposed to fall hazards. This condition exposed employees to a fall hazard of approximately 14 feet and 17 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
