29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:     (a)Reede Construction, Inc. @ Mount Rushmore Road, Rapid City, SD 57071:  On and prior to 4/13/16, the controlling employer did not ensure that adequate protection was provided, in that, the spoil pile was less than 6 inches from the edge of the excavation along the east wall adjacent to Mount Rushmore Road. Subcontractor employees were exposed to the hazard of the spoil pile falling into the excavation while placing a 45 degree elbow of 48 inch RCP (Reinforced Concrete Pipe). This condition caused an overburden to be placed on the vertical walls of the excavation which exposed subcontractor employees to cave-in.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c)     (a)Reede Construction, Inc. @ Mount Rushmore Road, Rapid City, SD 57071:  On and prior to 4/13/16, the controlling employer did not ensure that each employee working on the east and west side of the excavation was protected from cave-in, in that, the excavation measured depth 5 feet 6 inches in height and lacked any protective system such as sloping, benching, or a shield system. Subcontractor employees within the excavation were placing a 45 degree elbow of 48 inch RCP (Reinforced Concrete Pipe). This condition exposed subcontractor employees to crushing hazards by excavation wall cave-in.
