29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 4/25/16 at a new residential housing project located at 270 Niagara Street, Buffalo, New York; employees working on Building #5 were installing shingles on the roof of a 2 story house with a 8 in 12 roof pitch and an eave height of approximately 17 feet. There was no fall protection in use. NO CERTIFICATION ABATEMENT REQUIRED

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a) On or about 4/25/16 at a new residential housing project located at 270 Niagara Street, Buffalo, New York; employees roofing Building #5 were using ropes with rope grabs attached to their harnesses. The employees did not have their rope grabs adjusted or rigged to prevent free falls more than 6 feet. NO ABATEMENT CERTIFICATION REQUIRED
