29 CFR 1910.178(l)(3)(i)(J): Any vehicle inspection and maintenance that the operator will be required to perform; The employer had not ensured that the Receiving Manager who was responsible for inspecting the Real Lift sit-down propane powered forklift had received sufficient training to understand what was considered a deficiency which adversely affected the safety of the forklift, and repairs are not performed before the forklift was put back in service.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On April 26, 2016, on the Real lift sit-down propane forklift, the seatbelt was broken and the head gasket on the engine was leaking and the employer had not taken the forklift out of service.
