29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    a) On April 27, 2016, General Manufacturing, LLC did not ensure that a written respiratory protection program was established and implemented for those employees who voluntarily wore 3M 5200 half-mask, negative-pressure respirators.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) On April 27, 2016, General Manufacturing, LLC , the employer did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:    1) Requirement for labeling of containers of hazardous chemicals;  2) Material safety data sheet availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be in the workplace;  5) Methods to inform employees of the hazards on non-routine tasks; and  6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system; and any precautionary measures to protect employees.    Employees were exposed to hazardous chemicals, including mineral oil mist and petroleum distillates. (b) On April 27, 2016, General Manufacturing, LLC did not provide training to employees by December 1, 2013 on the revised Safety Data Sheet format and content, as well as the new labeling elements as required by the revised hazard communication standard 29 CFR 1910.1200. 29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.    (a) On April 27, 2016, General Manufacturing, LLC did not ensure that the cut off Gatorade bottles that contained oil in the grinding area were labeled, tagged, or marked with the product identifier and general information regarding the general hazards of the chemicals being used in the workplace.    (b) On April 27, 2016, General Manufacturing, LLC did not ensure that spray bottles containing Perkote 30-248 in the CNC machining area were labeled, tagged, or marked with the product identifier and general information regarding the general hazards of the chemicals being used in the workplace.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
