29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations:    a) Phase IV Building, outside of the dike in front of the MBS/SPS Catalyst Tanks - On or about April 5, 2016, the employer did not implement the emergency response plan for employees involved in the response to and cleanup of a sodium metabisulfite / sodium persulfate chemical spill, thus exposing employees to conditions such as but not limited to respiratory hazards.

29 CFR 1910.120(q)(3)(iv): Employees engaged in emergency response and exposed to hazardous substances presenting an inhalation hazard or potential inhalation hazard, did not wear positive-pressure self-contained breathing apparatus until such time that the individual in charge of the incident command system determined through the use of air monitoring that a decreased level of respiratory protection would not result in hazardous exposures to employees:    a) Phase IV Building, outside of the dike in front of MBS/SPS Catalyst Tanks - On or about April 5, 2016, employees involved in the response to a sodium metabisulfite / sodium persulfate (MBS/SPS) chemical spill were exposed to unknown levels of air contaminants while wearing full-face air-purifying respirators during the containment and clean up of the spill, resulting in potential respiratory hazards.  Air monitoring in the area of the MBS/SPS spill was not conducted prior to or during the response.
